A judge ruled yesterday he could not consider an appeal against her ruling allowing three prisoners to remain on death row after they beat and poisoned their female victim. The High Court has accepted argument from three prisoners in the case at High Court in Belfast that they will not survive prison if they are executed as a first offence. They are set to be paroled on July 1 next year, when the Parole Board will decide whether to continue their life sentence. The three were convicted of murder Sarah Dunstan, 26, in December the former Shankill <$%OUTSIDE_LINK_0%$> Road area of north Belfast in July 2006. They confessed to the crime under stress, before confessing that they had killed because thought Ms Dunstan would be going out with somebody else. Three men have been granted parole in the case. Two are custody in England, one is and was granted the right to challenge his case at the European Court of Human Rights. Lord Mayor of Belfast Sadiq McEntee said: "The council and the community will be hoping that they do survive prison before the end of this year. "This is a tragic case of life threatening circumstances, and we will, of course, be supporting them throughout and we would hope that all the evidence is heard in public as they decide what has to be done for them in terms of their release. "We are also aware that their relatives have expressed concerns about this case and have asked the Parole Board to continue providing support, which is one of the principles behind Parole Board Act 2004. "A review of the legislation is <$%INSIDE_LINK_1%$> taking place, with the aim of making it more effective in ensuring that this situation is handled more effectively and less costlyly in the future." Mr McEntee said Ms Dunstan, who was a student, had recently started studying at the university after falling pregnant, but did not know the identity of her killer. "Her tragic death was preventable and she would not have died if the perpetrators had served their full sentence while they were detained at Ashfield Prison. Mr McEntee also asked: "How many women would have been killed by a group of male prisoners who all chose one individual as a victim who they thought might be going out with someone else?" He said: "The people in prison, like many Northern Ireland, are vulnerable and in the long term they will continue to face issues of crime and criminality." Lord Chief Justice Judge concluded last month that prisoners who kill or are involved in violent acts, or who commit crimes outside prison "remain liable to be committed for life". But he said: "There is no justification for executing a person who has not committed an appropriate act for which his life has thus ended." He also said that while prisoners were entitled by law to appeal against any decision release them, "there is always the fear that their sentence will be increased" if their appeal fails. The judges said: "Prisoner killers should have the freedom to decide whether and when they wish to seek parole. cannot realistically be said to deterred by fears of prison sentence increases. "The court cannot accept that any person in prison for life should be spared <$%INSIDE_LINK_0%$> his liberty if he intends to commit a murder later in the life and this will give effect to our commitment human dignity."
